Stormwater Management is mandated by the US Environmental Protection Agency (EPA) through 1987 Amendments to the Clean Water Act. This program is implemented in NYS by the Department of Environmental Conservation (DEC). DEC has issued "General Permits" to regulate stormwater from construction sites and municipalities.
In NYS, anyone disturbing greater than 1 acre of soil is required to gain coverage under the State Pollutant Discharge Elimination System (SPDES) General Permit for Stormwater Discharges from Construction Activity (GP-0-15-002).
In Chemung County, there are MS4 communities, designated by the State,through SPDES General Permit for Discharges from Municipal Seperate Storm Sewer Systems (MS4) GP-0-15-003. This means that these communities are required to have a Stormwater Management Program. This program includes local laws for Stormwater Management, as well as Erosion and Sediment Control, from construction sites. Below is a map outlining these communities.

UPDATE: New York State DEC has updated the Notice of Intent for the SPDES General Permit for Stormwater Discharges from Construction Activity to address the Runoff Reduction criteria in the 2010 version of the NYS Stormwater Design Manual. The new Notice of Intent is available as a PDF under “Forms” header on the Stormwater Permit for Construction Activity webpage.
DEC will not accept the old NOI form after October 1, 2013.
In addition, DEC has developed worksheets to help owners/designers account for runoff reduction techniques and complete the new questions that were added to the Notice of Intent. The worksheets are available as Excel spreadsheets under the “Additional Tools” header on the Construction Stormwater Toolbox webpage (www.dec.ny.gov/chemical/8694.html#Additional).
